Sub: Preparation of India’s Offer List for Peru under Trade in Goods Chapter for negotiations for the India-Peru Trade Agreement

As you may be aware, the 7th Round of India-Peru Trade Agreement negotiations took place in New Delhi, India from April 8 to April 11, 2024. From Indian side Mr. Rajesh Agrawal, Additional Secretary, Department of Commerce was the Chief Negotiator and from Peruvian side was represented by Mr. Gerardo Antonio Meza Grillo, Director for Asia, Oceania and Africa, Ministry of Foreign Trade and Tourism, Republic of Peru. During the negotiations both sides have broadly agreed to exchange goods offer in HS 2022 nomenclature with effective duty as on 01.01.2024.

Considering the progress in the ongoing India-Peru Trade Agreement negotiations, the Ministry of Textiles has sought inputs from the Council on the level of tariff concessions that may be given to Peru pertaining to the Manmade fibre Textiles and Technical Textiles products. Tariff lines on which comments sought are attached (Click to Download them below).

Reference the trailing email on the subject cited above,

During the 7th Round of India-Peru Trade Agreement negotiations, it was broadly agreed that both sides will exchange goods offer in HS 2022 nomenclature with effective duty as on 01.01.2024.
In light of the ongoing negotiations, please find attached the following documents for your kind perusal and needful action as indicated:

a.      An Excel sheet containing 20 Tariff Lines where the Ministry of Textiles has granted a 100% Margin of Preference (MoP) [Immediate Tariff Elimination from the date of entry into force of this agreement]. It may be noted that earlier Ministry of Textiles has provided their inputs in HS 2017 nomenclature which was further, concorded to HS 2022 nomenclature by this department. Therefore, a line of confirmation for 100% MoP may be provided for the same.

b.      An Excel sheet containing 1 tariff line where Ministry of Textiles has provided 50% Margin of Preference. We kindly request reconsideration of the input to ensure equitable market access, especially considering that the same line has been opened in previous FTAs with EFTA, Australia, UAE, Korea, Japan, which would foster healthy competition among FTA partners.

c.      An Excel Sheet of additional 20 TLs is also enclosed where inputs are still awaited by this division (Email shared on 11.03.2024).

d.      An Excel Sheet of Peru's Wishlist comprising of 5671 tariff lines (along with DGCIS Description) for market access in India at HS 2022 nomenclature with effective duty as on 01.01.2024 has been attached with a request that Ministry of Textiles may provide their inputs/comments on the tariff line pertaining to them in case, any tariff line is not covered in point (a), (b)& (c) as mentioned-above.

e.      Ministry may categorize their inputs in the following modalities:

i.      Tariff Elimination Immediate (TEI)–Immediate tariff elimination of 100% on effective duty from the date of entry into force of this agreement.
ii.     Tariff Reduction Immediate (TR) – Immediate tariff reduction of 50% on effective duty from the date of entry into force of this agreement.
iii.    Phased Elimination - Phased elimination of 100% on effective duty for the period of 5 years or 10 years from the date of entry into force of this agreement.
iv.     Phased Reduction -Phased reduction of 50% on effective duty for the period of 5 years or 10 years from the date of entry into force of this agreement.

In addition to the above information regarding the Production Linked Incentive (PLI) and Phased Manufacturing Programme (PMP) tariff lines pertaining to Ministry of Textiles at HS 2022 nomenclature, if any, may also be indicated in the designated column of the attached Excel Sheet (Peru’s Wishlist).

Sir/ Madam,

India and Peru are negotiating Trade Agreement and 5 rounds of negotiations have been held so far. The 5 th (last) round of negotiations was held with Peru in August, 2019. The 6 th round which was scheduled earlier could not be held due to Covid disruption. Now, both sides have resumed negotiation for Trade Agreement and a Special Round was held during 10-11th October, 2023.

2. The 6 th round of negotiations is to be held with Peru in the coming month. India and Peru are required to exchange their offers on their respective Wish Lists before the 6 th round.

3. Peru has shared their Wish List at 8-digit level (as per HS 2017) seeking Margin of Preference (MoP). The details of the tariff line at 8-digit level (in excel format) contained in the Peruvian Wish List pertaining to the Ministry of Textiles is enclosed in excel format.

4. The Ministry of Textiles is requested to indicate Margin of Preference (MoP)/ Exclusion with justification against each of the tariff line for Peru under the ongoing Trade Agreement negotiations. The information may be shared in the columns specified for comments in the attached Excel Sheet.

5. As the Offer is to be shared with the Peruvian side by the first week of November, 2023, the inputs may be expedited positively by 28.10.2023 at Email Id: moc_ftlac@nic.in , usftlac-doc@gov.in.
