General Waiver of penalty for late filing of Bill of Entry due to the ICES being for DR Drill and Maintenance

Sub: General Waiver of penalty for late filing of Bill of Entry due to the ICES being for DR Drill and Maintenance  

Dear Member,       

JNCH has issued Public Notice No. 35/2022-23 dated 29^th June, 2022 on the above subject. 

As per Advisory No. 11/2022 dtd. 22.6.2022 issued by DG Systems for Disaster Recovery Drill, from 24^th to 26^th June, 2022, filing of Bill of Entry at Service Centers and through RES (Remote EDI System) was stopped at 22:00 hours on 24^th June, 2022. Though ICES (Indian Customs EDI System) was functioning intermittently on 25^th June, 2022, members of Trade faced difficulty in filing the Bills of Entry, on time, on that day. 

As a measure of trade facilitation, JNCH has now decided that –   

• “Late fee’ imposable in terms of Bill of Entry (Forms) Amendment Regulation, 2017 vide Notification No. 27/2017-Cus. (NT) dtd. 31^st March, 2017 will not be collected for 25^th and 26^th June, 2022, if a Bill of Entry could not be filed on these days.  
• This waiver however is subject to submission of negative acknowledgment/ proof of non-generation of Bill of Entry Number.
