Sub: Monitoring of realization of export proceeds for shipping bills for which drawback has been claimed and disbursed

Dear Member,

Kindly refer to Council’s Circular No. ES/4/2022-23 dated 4^thApril, 2022 detailing JNCH Public Notice No.20/2022 dated 25^th March, 2022 on Non/Part Realization of export proceeds for shipping bills on which drawback has been claimed and disbursed during the period from 1^st April, 2014 to 31^st March, 2018.

In this regard, as you are aware eBRC details were earlier available only for the year 2014-15, but due to lot of persuasion from EPCs, Trade Bodies, and individual exporters, details are now available for 2015-16, 2016-17 and 2017-18 on JNCH website, attached to the Public Notice OR you may download the Shipping Bill details by following the link (https://tinyurl.com/yd9sd2w7).

The Council is grateful to JNCH for uploading the data for all the 3 consecutive years.

In case, details of Shipping Bills, FOB Value and Drawback Amt. are missing in the file against your IEC Number and Company Name, you may kindly contact JNCH or your concerned Bank requesting to provide details of the same.

On receiving information of the Shipping Bills, members are advised to do the needful -

Follow up with your Authorized Dealer Banks for updating export proceeds realization details in the respective bank’s EDPMS so that the data is transmitted to Customs for reconciliation.
VERY IMPORTANT FUNCTIONALITY is available on the ICEGATE Portal where you can verify the export proceeds realization details in respect of individual export shipment and raise queries related to rectification required if any.
To know about the process of verification/ rectification of S/Bill wise export realization details, kindly refer to the Advisory (given along with JNCH’s Public Notice No. 20/2022 as ‘Annexure A’).
If export proceeds have been realized, then details of such realization may be updated in EDPMS through your Authorized Dealer Bank for reconciliation.

(Failing which appropriate action for recovery of ineligible drawback disbursed along with interest shall be initiated by JNCH).
Please refer to CBIC Circular No. 33/2019 dated 19^th September whereby it is mentioned that -
"In cases where the short realization of export sale proceeds is due to -

(i) bank charges deducted by foreign banks or
(ii) agency commission paid to agents abroad for securing export contracts,

You are required to produce documentary evidence (Export Invoice, Bank’s Confirmation regarding foreign bank charges etc.) to justify such deductions"
